Collaborative Law

Collaborative law is a viable way to resolve legal disputes and is an efficient, cost-effective alternative to the traditional win-or-lose litigation. The collaborative system was created when it became clear that court trials in dissolution cases were inflicting greater injury to families than the underlying divorce itself. Collaborative law encourages full client involvement in resolution, which leads to greater client satisfaction with the end result.
Collaborative law is founded on the premise that greater satisfaction is gained through client participation in creating the solution, instead of putting decisions in the hands of the court. First, all parties agree court action will not be sought out and if it is, both collaborative law attorneys must withdraw from representation. Clients attend a series of meetings with both clients and attorneys in order to deal with the underlying emotions and issues regarding the transition from married to divorced including: forming a viable parenting plan, child support, division of assets, and maintenance if needed. Clients are fully involved in all decisions and thus it is possible to create a solution in which all parties feel content.

Collaborative law is very effective in family law cases where a continued relationship between the parties is necessary (children in common). Collaborative law is usually a time saving and cost effective method, which fosters a healthy future relationship with your former spouse.
